Drunk Driving Defense Attorney in Oakland County
Drunk driving is a serious offense in the State of Michigan. Recent legislation has enhanced the penalties for drunk- driving violations. This enhancement includes making a third drunk driving offense a felony in the State of Michigan. A felony conviction for a third drunk driving offense may land the defendant in prison. Consequently, for any drunk-driving offense it is imperative that the defendant has experienced legal representation.
The role of the attorney is as follows: The attorney should interview the defendant to analyze the facts and circumstances surrounding the drunk-driving charge. That information must be compared to the police report and evaluated in light of current Michigan case law. For example, a drunk-driving charge that resulted from an illegal stop may with proper legal representation be dismissed. The attorney, after his evaluation, can properly advise the client of the chances of taking the case to trial. Furthermore, it is the attorney’s responsibility to represent the client at a pretrial where it is possible that the charges may be reduced or the case dismissed altogether.
